The court of Appeal sitting in
Ibadan has finally dismissed an appeal by the Governorship
candidate of the ANPP in the 2007 Governorship Poll in Ogun
State Senator Ibikunle Amosu against the victory of Otunba
Gbenga Daniel of the Peoples Democratic Party. In a unanimous
judgment today in Ibadan, the Honorable Justice Mohammed Garba
led five man panel, upheld the election tribunal judgment which
declared Otunba Gbenga Daniel as winner of the April 2007
Election in Ogun State.
Supporters of the two opposing parties the ANPP and PDP from
Ogun State arrived the courtroom early enough awaiting final
words, the sixth in the series of judgment and the last of all
judgment over the declaration of Otunba Gbenga Daniel as
Governor of Ogun State in 2007. Expectedly, in any courtesy,
there must be a winner and a loser. The Hon. Justice Mohammed
Garba led Panel of judges commenced proceeding at ten in the
morning and unanimously dismissed the appeal notice of the ANPP
Governorship candidate Senator Ibikunle Amosu for lacking merit.
Senator Amosu had gone to court to challenge the ruling of the
Hon. Justice Sulaiman Ambusa led election petition tribunal in
Abeokuta which upheld the election of Otunba Gbenga Daniel as
Governor
In a 130 page judgment the panel contended that the appellant
failed to provide enough proof with evidences on all allegations
of election malpractices and criminality during the election.
Responding to the judgment, the Counsel to the appellant Dr.
Walib Egbewole who stood in for the led counsel and Prof Taiwo
Osipitan Counsel to the PDP including Olayode Delano for the
INEC say, the judgment was well considered. Meanwhile it was
jubilation galore by supporters of the ruling PDP who were at
the appeal Court after the judgment. Members of the Panel of
Judges are Hon. Justice Mohammed Garba, Hon. Justice T. Abdulahi,
Hon. H.M. Ogunwumiju. Hon. A.G. Msheila and Hon. Justice Adamu
Jauro, with the lead judgment delivered by Hon Justice Mohammed
